Amendments

Idlesoft LLC reserves the right to amend any or all of the policies, guidelines and disclaimers without notification.

General

All services provided by Idlesoft LLC may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any France law is prohibited. The subscriber agrees to indemnify and hold harmless Idlesoft LLC from any claims resulting from the use of service which damages the subscriber or any other party. Failure to comply with any terms or conditions will result in the deactivation of the account in question. As our customer you are responsible for all your accounts.

Account Activation

By activating your account with Idlesoft LLC, you agree to the Terms of Service, Acceptable Use Policy, Privacy Policy and Disclaimers regarding Idlesoft Hosting. If you sign up for an account and fail to comply with these terms, no refunds will be given.

Billing

Idlesoft Hosting is a prepaid service. Users pay the service upfront, and will receive the service paid for as promised.

Money back guarantee & refund policy

Customers can choose to end their service prior to the end of their service term. Idlesoft LLC will then refund the customer pro rata, calculated at daily intervals. If users cancel within a week of the start of their service, we will refund 100%. In case of agreement violations, any and all refunds are forfeit.

Acceptable Use Policy

Failure to follow the Acceptable Use Policy will be grounds for immediate account cancellation without chance of refund. Violations of the Acceptable Use Policy should be referred to aup@idlesoft.net. All complaints will be investigated promptly.

Traffic Usage

All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and have the right to disable any account who's traffic has been exceeded. This disabled state will continue to apply up to the 1st day of the next month, or until more bandwidth is purchased.

Backups

Idlesoft LLC will not be able to guarantee your data will never become corrupted or lost, for whatever reason. Therefore you are urged to make your own backups, at regular intervals, and store these in a secure location, outside of the Idlesoft LLC network. Idlesoft LLC shall not be responsible for data loss or corruption, or any damages resulting from this.

Server Uptime Guarantee

Idlesoft LLC guarantees 99.9% uptime on all hosting plans. Should we fail to deliver this for any given calendar month, your account will be given an extra, free month under your current plan. The uptime is calculated as the percentage of time in minutes the service was operating as expected. All downtime causes that are out of our control, including but not limited to DoS, DDoS, maintenance, malfunction of 3rd parties services, etc., are excluded from this calculation. Thus, uptime is calculated as: 100% - ([minutes of downtime eligible] / ([minutes in the month] - [minutes of downtime not eligible]) * 100%). The uptime values for each month will be regularly posted at http://idlesoft.net/cms/hosting/uptime-history.

Disclaimer

Idlesoft LLC shall not be responsible for any damages, including incidental and consequential damages, which may arise from Idlesoft LLC’s servers going off-line or being unavailable for any reason whatsoever. Idlesoft LLC shall not be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Furthermore, Idlesoft LLC shall not be responsible for any damages, including incidental or consequential damages, resulting from the corruption or deletion of any data from any of Idlesoft LLC’s servers. Moreover, Idlesoft LLC holds no responsibility for the actions of our clients' accounts, and does not review, edit, censor or take responsibility for any information its subscribers may create.
